REAL ESTATE ISSUES AND DISPUTES

We advise and undertake representation in connection with issues and disputes concerning real property located in Southern California or in the San Francisco Bay Area, most notably concerning: ownership, co-ownership (rights and obligations between co-owners), title (including title insurance coverage, possible resulting and constructive trusts), easements, interference with property rights (e.g. nuisance, trespass), leases and the landlord/tenant relationship, sales transactions (e.g. possible breach of contract, fraud), and liens (e.g. judgment liens, mechanics liens, trust deeds). Details concerning many of these items are set forth on the pages of this website.

Where we do take on representation in connection with a dispute, its resolution may have to be sought by way of out of court mediation (as required under the standard real estate purchase contract), out of court binding arbitration (as may be required under the standard real estate purchase contract if the relevant paragraph is initialed), or by suit in the Superior Court and consequent ‘in court’ mediation or trial.
